Bayer Reports $1.4 Billion in Yaz and Yasmin Settlements

Bayer Pharmaceuticals has announced that it has settled almost 6,700 lawsuits related to its Yaz and Yasmin birth control products. In the $1.4 billion Yaz lawsuit settlement, Bayer did not accept responsibility for their products causing deep vein thrombosis, pulmonary embolisms, or other blood clot injuries. Bayer has yet to reach Yaz and Yasmin settlements in more than 5,400 other cases, of which almost 2,700 have alleged similar injuries. Bayer also announced that a Yaz lawsuit settlement has also been reached in almost 8,800 cases in which plaintiffs claim that Yaz or Yasmin produced gall bladder injuries. The use of the birth control pills has reportedly been linked to the occurrence of Yaz gall bladder disease which can lead to the removal of this organ. In this settlement, Bayer reportedly agreed to settle for payments totaling $24 million. The terms of the settlement include a $2,000 payment to patients who suffered a gallbladder injury and a $3,000 payment to those who had their gall bladders removed. The 8,800 plaintiffs which have acceded to the settlement terms exceeds the 90 percent participation threshold, allowing the settlement to proceed.

Yaz lawsuit settlement for blood clot related injuries

Initially introduced in 2006 in the United States, Yaz and Yasmin were marketed as birth control medications with effectiveness in treating premenstrual syndrome and acne. Yaz and Yasmin act to elevate potassium levels which can produce heart arrhythmias, hyperkalemia, stroke, blood clots, embolisms, hyponatremis, and even death. A study by the British Medical Journal in 2011 reported that Yaz and Yasmin users could double their risk of blood clots compared to alternative birth control drugs.

Bayer’s response to adverse event reports

As the manufacturer of Yaz and Yasmin, Bayer is responsible for providing adequate warnings to users of their products. In the Yaz lawsuit settlement, many plaintiffs claimed that Bayer utilized deceptive marketing practices which exaggerated benefits and virtually ignored the serious side effects which could result. Some of these Yaz lawsuits alleged that Bayer was negligent in not studying the potentially serious and fatal injuries that could result from Yaz or Yasmin use. Although Bayer did modify its advertising following an FDA study which questioned the safety of Yaz and Yasmin thousands of users may have already suffered blood clots or other serious injuries.

Yaz litigation

While many of those injured by the oral contraceptives have participated in the Yaz and Yasmin settlements, many more of these lawsuits continue through the legal system. To date more than 11,000 cases related to these products have been filed. Many of these lawsuits have been consolidated into a Yaz multidistrict litigation or MDL currently being litigated in the U.S. District Court of Southern Illinois. Although similar to a class action lawsuit in that legal resources may be pooled, a MDL allows individual plaintiffs to retain control over their lawsuit including the ability to pursue a jury verdict or independent settlement. Bayer is still embroiled in negotiations with more than 5,000 litigants who are seeking a different outcome. Bayer agrees to settle Yasmin, Yaz Gallbladder lawsuits

Bayer’s latest annual financial report shows the company has spent nearly $1 billion to settle around 4,800 claims alleging Yaz blood clots, and will continue to evaluate new claims for settlement on a case-by-case basis.

(Reuters) – Bayer AG has entered into an agreement to settle lawsuits filed by plaintiffs who claim to have suffered gallbladder injuries from the company’s Yasmin and Yaz oral contraceptives, according to court documents.
In a deal reached on Friday, Bayer agreed to pay up to $24 million to settle gallbladder injury claims consolidated in the U.S. District Court for the Southern District of Illinois, as well as in state courts in California, New Jersey and Pennsylvania.
Under the agreement, Bayer will pay $2,000 to plaintiffs who suffered gallbladder injuries and $3,000 to individuals who had their gallbladders removed, according to the agreement. The gallbladder mainly aids in fat digestion, but it is a non-essential organ people can generally live without, according to the National Digestive Diseases Information Clearinghouse.
The payments may be reduced, depending on the number of women who file claims, as the settlement is capped at $24 million. Bayer reserved the right to walk away from the settlement if fewer than 90 percent of the individuals who are eligible for payment choose to participate in the settlement.
Bayer said in a statement that it did not believe that the Yaz and Yasmin birth control pills increase the risk of gallbladder disease, compared to other oral contraceptives.
“Nevertheless the company has agreed to this settlement, without admission of liability, in order to avoid protracted and expensive litigation and to resolve the vast majority of pending gallbladder claims,” a Bayer spokeswoman said in an emailed statement. She said the $24 million settlement was likely less than the legal costs of defending against the suits.
Since 2009, Bayer, Germany’s largest drugmaker, has been hit by a wave of lawsuits claiming that the company knew or should have known of the health risks allegedly posed by the Yasmin and Yaz contraceptives and failed to warn users. The company is facing around 10,000 lawsuits in the United States over the drugs, Bayer said in its annual report filed in February.
BLOOD CLOT DAMAGES
The report said Bayer had reached agreements to pay $1 billion to settle claims by 4,800 women or their representatives in the United States who say the pill caused blood clots that resulted in heart attacks, strokes or other injuries. After reviewing safety data, the Food and Drug Administration in April 2012 ordered revised labels on birth control pills, including Yasmin and sister drug Yaz, to strengthen blood clot warnings.
There are around 8,000 filed lawsuits that allege gallbladder injuries, said David Zoll, an Ohio lawyer representing 500 women who say they suffered a range of injuries from Yasmin and Yaz. The latest settlement is open to plaintiffs who alleged a gallbladder injury, either alone or in combination with some other claim.
Zoll said it would be “foolish” for women with both gallbladder and blood clot injuries to opt for the gallbladder settlement since they would be barred from also collecting a blood clot settlement, which is typically larger. Damages in blood clot cases can exceed $100,000, he said.
Women who do collect $3,000 for gallbladder removals may not be left with much after deducting lawyers’ fees, filing fees and the costs of obtaining medical records. Health insurance plans may also be able to claim any leftover amount to reimburse what they paid for medical expenses, Zoll said. Nevertheless, he strongly encouraged his clients with gallbladder injuries to accept the settlement.
While modest, the settlement was the best lawyers for the plaintiffs could achieve, Zoll said, given the lack of epidemiological studies showing that users of Yasmin and Yaz have a higher risk of gallbladder disease, compared to other oral contraceptives.

The lawsuit says that Yaz is a dangerous prescription drug sold without adequate warnings about the risks of severe, lasting, and potentially fatal injuries. Littles stated in a news releases that she was “bringing this lawsuit so that this traumatic event does not happen to anyone else. I nearly died from taking this medication–the hospital even brought in a priest for me.” Littles suffered “bilateral pulmonary emboli, cor pulmonale, and deep vein thrombosis (“DVT”), more commonly known as a blood clot. If left untreated, blood clots can break off and result in life-threatening conditions.” The lawsuit claims that Littles would not have been injured if Bayer had properly warned consumers of the dangers of using the drug Another Florida Yaz Story I was admitted into the hospital 3 weeks ago. I was experiencing numbness of the entire body (primarily on my left side), my hands were cramping up and I felt like I was blacking out. The ambulance came to get me and I was brought to Florida Hospital, they quickly ruled out a stroke since I was so young, but focused on MS and Lupus (those tests came back negative). After 3 days they sent me home with no answers. So after 3 weeks of being in and out of the hospital and doctors offices (with minimal feeling and total weakness of my left side), I was sent up to the Mayo Clinic in Jacksonville. After sitting with the neurologist telling him what was going on and him reading my reports he found the answer- I HAD A STROKE! This is the scary part- my stroke was caused by my birth control. He continued to tell me that in the last 6 months he has seen more and more young women (20’s and early 30’s) that are having strokes and all have one thing in common- YAZ BIRTH CONTROL, which is the brand I am on. It is nice to finally have an answer, but I still have to go through tests to find out exactly where the clot is/was and if it’s still there. He said I may never regain the strength or feeling back on my left side, but that is something we’ll have to wait to see. I also can NEVER go on any type of birth control ever again! But I can’t imagine not knowing that and still continue to take the Yaz, b/c I would continue to have strokes! If any of you are taking this birth control, please look into switching to another one. I’m not sure if the doctors at Florida Hospital know about this, but they were more focused on MS than they were stroke. We may never be 100 percent certain just how many women have died from conditions related to the effects of Yaz, Yasmin, and Ocella. While it may prove impossible to gauge a precise figure, at least 50 out of 4,000 plaintiffs are families that have suffered the loss of their mother, sister, or daughter after having been prescribed one of Bayer’s popular birth control pills.

North Carolina Yaz Side Effects Lawsuit: Deep Vein Thrombosis (DVT)

A woman living in North Carolina recently filed a Yaz lawsuit after she allegedly suffered deep vein thrombosis (DVT) in January 2007. The lawsuit alleges that in addition to the conscious suffering caused by the deep vein thrombosis (DVT), this woman also suffered from the amputation of her leg below her right knee as a result of the DVT. The lawsuit alleges that had she or her health care providers known of the serious health risks associated with the use of Yaz, she would not have used Yaz and would not have suffered these injuries.

A CBS Business Net article published in June of 2009 reports on an early suit filed against Bayer over a death allegedly caused by Yaz. The 2009 suit states, “Defendants have been warned at least three times by the FDA; in 2003, 2008 and 2009, for misleading the public through the use of ads which overstate the efficacy of YAZ and/or its predecessor Yasmin, and minimize serious risks associated with the drug.”

Another CBS article in July of 2009 reports on the number of deaths through 2008. A lawsuit filed during that time states, “In fact, in less than a five-year period, from the first quarter of 2004 through the third quarter of 2008, over 50 reports of death among users of Yasmin and Yaz have been filed with the FDA,” the article quoted.

A more recent article published in the Elon University Pedulum in November 2010 reports on the case of Michelle Pfleger, a freshman at Elon, who died on September 24, 2010 while taking Yaz. Pfleger’s mother, Joan Cummins, has filed suit against Bayer. She claims that Yaz caused the clots that led to her daughter’s death. Pfleger was prescribed Yaz for acne, although one of the listed “common side effects” of Yaz is an increase in acne.

The Pendulum reports, “The day before she died, Pfleger had been treated with an analgesic by a physician due to a knee injury. Cummins said it was a normal injury, which raised questions about where the clots came from.” Cummins and her lawyers agree that the clots most likely came from Yaz. Now it is up to the courts to decide. Yaz has very serious side effects.
