Now we have two birth control devices under scrutiny and both manufactured by Bayer Pharmaceuticals. Bayer is the manufactuer of Yaz a birth control pill  with warnings for blood clots, pulmonary embolism, deep vein thrombosis and strokes in young women. On October 25, 2011, the British Medical Journal published a study from the University of Copenhagen linking the hormone in Yaz to blood clots.     Bayer AG (BAYRY) said settlements of U.S. lawsuits over claims that its Yasmin line of birth-control pills caused blood clots in women have increased to more than $402 million.

Bayer, based in Leverkusen, Germany, has resolved almost 1,900 cases (BAYRY) in which it’s alleged that its Yasmin and Yaz contraceptives caused clots that can lead to heart attacks and strokes, the company said today in a stockholders’ newsletter. Bayer said it has paid $402.6 million in settlements of one category of clot cases, for an average of about $212,000 a case.

Bayer also more than doubled its reserve for Yaz cases, setting aside 496 million euros ($610.5 million), the company said. The drugmaker set aside a total of about 200 million euros in 2010 and 2011, according to securities filings.

“We believe we have made appropriate provisions for most of the cases we consider to be worthy of settlement with these accounting measures,” Bayer officials said in an e-mailed statement.

Drug-industry analysts, such as JPMorgan Chase & Co.’s Richard Vosser, have said Bayer may have to pay more than 2 billion euros to resolve all the cases over the pills.
Stronger Warnings

In April, the U.S. Food and Drug Administration ordered Bayer and other contraceptive makers to strengthen blood-clot warnings on their products.

Pills like Bayer’s Yasmin, which contain a synthetic hormone called drospirenone, will have warning labels saying researchers found they may triple the risk for clots.

The FDA examined data on more than 835,000 women who took pills containing drospirenone, including Bayer’s Yasmin line, according to the FDA report. Yasmin was the No. 4 oral contraceptive in the U.S. in 2011, with 4.6 percent of the market as of September, according to data from IMS Health.

Bayer’s contraceptives generated $1.1 billion in sales in 2011, making them the drugmaker’s biggest-selling drugs after Betaseron, a multiple sclerosis medication and Kogenate, a medicine to treat hemophilia, according to data compiled by Bloomberg.
Revenue Forecast

Bayer released its stockholders’ newsletter on the same day it raised its 2012 revenue and earnings forecasts, citing increased sales of crop chemicals and drugs as well as favorable exchange rates.

Bayer said revenue will gain about 4 percent to 5 percent this year to 39 billion euros to 40 billion euros, excluding currency and portfolio changes. The company previously forecast a sales increase of about 3 percent.

Bayer’s American depositary receipts (BAYRY), each representing one ordinary share, rose 1.92 percent to $75.95 in over-the counter trading today in New York. Shares in Germany climbed 1.3 percent to 61.60 euros.
Beyond Insurance

The $610.5 million Bayer set aside this quarter is to pay the company’s costs beyond what insurance will cover for legal fees and accords, including cases that haven’t been settled, a spokesman, Guenter Forneck, said in a telephone interview today. Bayer isn’t disclosing the amount of its insurance coverage.

In the newsletter, the drugmaker’s executives said Bayer faced more than 12,000 lawsuits over the Yasmin line of contraceptives, including claims that they caused blood clots in some women and damaged gallbladders in others.

So far, Bayer has agreed to settle 1,877 cases in which women blame the company’s contraceptives for causing clots in their veins. “Such injuries are alleged in about 6,000 claims and therefore in fewer than half the cases served to date,” Bayer officials said in the publication.
‘Making Progress’

“This indicates they are making progress putting these Yaz suits over the vein clots behind them,” Carl Tobias, who teaches product-liability law at the University of Richmond in Virginia, said in a phone interview.

Michael Burg, a Denver-based lawyer for women suing over the Yasmin line, said Bayer has refused to settle cases alleging the contraceptives also caused clots in women’s arteries.

“Those cases involve some of the more serious injuries and we look forward to trying them,” he said in a telephone interview today.

The drugmaker is rejecting women’s claims that the contraceptives damaged their gallbladders or caused gallstones, Burg said.
Wave of Litigation

Since 2009, the German drugmaker has faced a wave of litigation over the birth-control pills. Lawyers suing the company cited FDA reports of at least 50 deaths tied to the pills from 2004 to 2008. Plaintiffs’ lawyers contend in court filings that Bayer officials marketed the contraceptives for unapproved uses and misled women about their risks.

The cases filed in federal courts were consolidated before U.S. District Judge David Herndon in East St. Louis, Illinois, for pretrial proceedings.

Herndon scheduled a series of trials so juries could begin weighing claims that Bayer and its units marketed Yaz and other contraceptives as safer than rivals’ products while knowing they posed a higher clot risk.
Settlement Progress

At Bayer’s suggestion, Herndon called in Stephen Saltzburg, a George Washington University law professor, to serve as a mediator. Saltzburg’s job was to explore the possibility of “settlements in this litigation,” Herndon said in a December order.

The judge put the trial schedule on hold while Saltzburg met with lawyers for the drugmakers and former Yaz users.

Saltzburg said earlier this month that settlement talks are continuing between the company and women’s lawyers and progress is being made in resolving cases.

“There are always some holdouts, but I think we will settle the bulk of these cases next year,” Saltzburg told an Illinois newspaper July 5.

This evening I spoke to a mother in Louisiana who lost her 21 year old daughter due to a Yaz Bloot clot and Heart attack. This is a young 21 year old woman with her entire life ahead of her. I do not think there is any lawsuit that can mend that kind of anguish and pain. Yaz is a Birth control pill that many young college girls were taking. Yaz and Yasmin both contain drospirenone, a new type of progestin that is not found in any other birth control pills in the United States other than generic versions. This unique “fourth” generation progestin has been cited as the likely cause of many side effects of the birth control pills in Yaz blood clot lawsuit and Yasmin blood clot lawsuit complaints filed against Bayer by women throughout the United States.

In a study published in August 2009 in the British Medical Journal, researchers found that pills containing drospirenone, such as Yaz and Yasmin, may increase the risk of women developing blood clots to 6.3 times that of women not on birth control. By comparison, women who took birth control pills with the older progestin, levonorgestrel, had a much lower risk of blood clots on birth control.

On October 27th, the FDA followed with its own study entitled "Combined Hormonal Contraceptives and the Risk of Cardiovascular Disease Endpoints" which found drugs like Yaz could increase the risk of blood clots, DVT and pulmonary embolism by as much as 74%.

Now, the Institute for Safe Medicine Practices’ QuarterWatch has released a study on May 31, 2012 that lists Yaz and Yasmin as the second-ranking drugs for adverse events reported to the FDA in 2011. Together, they resulted in 8,354 side-effect complaints.

Due to the number of claims filed by Yaz patients, a federal Multi-District Litigation court was established in Illinois to handle lawsuits from those affected. The formal case is known as Yasmin and Yaz (Drospirenone) Marketing, Sales Practices and Products Liability Litigation (MDL No. 2100). The court estimates as many as 11,000 patients have filed a claim.

Bloomberg News reported on April 13, 2012 that Bayer would begin settling Yaz lawsuits at approximately $220,000 per case. In its first quarter Stockholders’ Newsletter for 2012, Bayer stated it had paid $142 million to settle more than 600 Yaz cases so far.

Now, The Madison Record has reported on July 11, 2012 that Stephen Saltzburg, the special master appointed to oversee settlement negotiations for the federal MDL case, estimates as many as 1,500 settlements have been reached for Yaz lawsuits and negotiations could be concluded within a year.

Lisa Spitzer MSW who runs the Transvaginal mesh helpline has heard many "horror stories" Equal to the Horror stories, if not worse, then silicone breast implants.

"It is important for woman to share their stories and find a support from others " The emotional and physical ramifications of these Transvaginal Mesh surgical implants, silicone breast implants, Mirena IUD, NuvaRing and other devices are severe" "These helplines assit women in locating a lawyer but, there is more to this then just legal advise and filing a  lawsuit" Monetary damages cannot reverse some  of the life changing  stories I am hearing" There are damaging physical and psychological effects from these surgical  implants that are far reaching. What was supposed to be a simple surgery to relieve bloating and constipation turned into a living nightmare for Linda Gross, 46, of Watertown, S.D.

Gross experienced pelvic organ prolapse, a condition in which the organs of the pelvis begin to shift because of a weakened pelvic wall. Her doctor implanted Gynecare Prolift, a relatively new type of surgical mesh, into her pelvic wall through incisions made in her vagina.

Ever since that implantation in 2006, Gross says she has had urinary complications, constant pain and swelling as her body continues to reject the mesh. She says she can't sit for more than 20 minutes, she can't have sex with her husband, she can't be active for more than a few minutes at a time. Twelve surgeries have failed to remove all the mesh or relieve her pain and swelling.

"It's horrible. There are unknown amounts of the mesh still in me. I have extreme pain. It feels like the inside of my vaginal wall is on fire," Gross told ABCNews.com. "I wouldn't wish this on anyone."

Symptoms of Silicone toxicity from Silicone breast Implants

Typical symptoms associated with silicone illness (also called "silicone poisoning" or "silicosis") include cognitive dysfunction, short-term memory loss, Sjogren's syndrome (dryness in the glands, such as the mouth, kidneys, eyes, and lungs), scleroderma, rheumatoid arthritis, dermatom-yositis, severe joint and muscle pain, incapacitating fatigue, swollen lymph glands, skin problems, peripheral numbness, multiple allergies, headaches, hair loss, sunlight sensitivity, central nervous system disorders (similar to multiple sclerosis), and others.

Complications from the vaginal Mesh

With the vaginal mesh there have been reports of recurring prolapse, vaginal scarring, vaginal shrinkage, and emotional problems related to the vaginal mesh. These complications often result in a patient requiring additional treatment, including surgery and further hospitalization.

The mesh helped keep the organs in place, but indications are that the transvaginal mesh harmed more than it helped. Some women who had the vaginal mesh surgery using it have reported "painful sexual intercourse, infections, urinary problems, overall discomfort, and bleeding, usually from the mesh eroding through the stitched tissue or from skin contracting tightly around it." Last year, 75,000 women had the vaginal form of the corrective surgery, and in the past two years, adverse event reports to the FDA have quintupled.

The FDA has also received reports that three women died in connection with the vaginal mesh surgery, and several other women are suing the device makers. One of their transvaginal mesh lawyers, who represents 75 patients, told the Globe, "It is unfortunate that the FDA came to these conclusions after all these people get hurt.''

“Consumers are justifiably upset when their cars, toasters, andbaby food bottles are recalled,” wrote Dr. Rita Redberg and Dr. Sanket Dhruva of the University of California, San Francisco, in an editorial accompanying the study. “Recalls make us all question the safety of the products we take for granted. But what aboutthe products permanently implanted inside our bodies?”. Unfortunately, products like vaginal mesh and faulty breast implants manufactured by the now-defunct French company Poly Implants Protheses SA, were cleared for use too quickly, resulting in disastrous consequences for women who were implanted with the devices. The French breast implants were not cleared for use in the U.S.

"Thousands of women have been left severely damaged by an implanted  vaginal mesh  to treat problems following childbirth, hysterectomy, or urinary incontinence."

"As a result  we are  now facing a crisis on a par or maybe even more far reaching ,  then claims for leaking silicone breast implants in the Nineties. "Says Spitzer.

"And Now we have a new one called the Mirena IUD. The Mirena is gravitating from its's original position and becoming embedded in the uterus and harming nearby organs.". Between Yaz, Yasmin, Fosamax, Vaginal mesh, Bladder sling and many others women are suffering nationwide and must seek justice"

    Pulmonary Embolisms – Pulmonary embolisms are extremely dangerous blood clots that appear in the lungs. Some of these blood clots form directly in or near the lungs and others are move  there after forming somewhere else in the body.
