Bayer agrees to settle Yasmin, Yaz Gallbladder lawsuits

Bayer’s latest annual financial report shows the company has spent nearly $1 billion to settle around 4,800 claims alleging Yaz blood clots, and will continue to evaluate new claims for settlement on a case-by-case basis.

(Reuters) – Bayer AG has entered into an agreement to settle lawsuits filed by plaintiffs who claim to have suffered gallbladder injuries from the company’s Yasmin and Yaz oral contraceptives, according to court documents.
In a deal reached on Friday, Bayer agreed to pay up to $24 million to settle gallbladder injury claims consolidated in the U.S. District Court for the Southern District of Illinois, as well as in state courts in California, New Jersey and Pennsylvania.
Under the agreement, Bayer will pay $2,000 to plaintiffs who suffered gallbladder injuries and $3,000 to individuals who had their gallbladders removed, according to the agreement. The gallbladder mainly aids in fat digestion, but it is a non-essential organ people can generally live without, according to the National Digestive Diseases Information Clearinghouse.
The payments may be reduced, depending on the number of women who file claims, as the settlement is capped at $24 million. Bayer reserved the right to walk away from the settlement if fewer than 90 percent of the individuals who are eligible for payment choose to participate in the settlement.
Bayer said in a statement that it did not believe that the Yaz and Yasmin birth control pills increase the risk of gallbladder disease, compared to other oral contraceptives.
“Nevertheless the company has agreed to this settlement, without admission of liability, in order to avoid protracted and expensive litigation and to resolve the vast majority of pending gallbladder claims,” a Bayer spokeswoman said in an emailed statement. She said the $24 million settlement was likely less than the legal costs of defending against the suits.
Since 2009, Bayer, Germany’s largest drugmaker, has been hit by a wave of lawsuits claiming that the company knew or should have known of the health risks allegedly posed by the Yasmin and Yaz contraceptives and failed to warn users. The company is facing around 10,000 lawsuits in the United States over the drugs, Bayer said in its annual report filed in February.
BLOOD CLOT DAMAGES
The report said Bayer had reached agreements to pay $1 billion to settle claims by 4,800 women or their representatives in the United States who say the pill caused blood clots that resulted in heart attacks, strokes or other injuries. After reviewing safety data, the Food and Drug Administration in April 2012 ordered revised labels on birth control pills, including Yasmin and sister drug Yaz, to strengthen blood clot warnings.
There are around 8,000 filed lawsuits that allege gallbladder injuries, said David Zoll, an Ohio lawyer representing 500 women who say they suffered a range of injuries from Yasmin and Yaz. The latest settlement is open to plaintiffs who alleged a gallbladder injury, either alone or in combination with some other claim.
Zoll said it would be “foolish” for women with both gallbladder and blood clot injuries to opt for the gallbladder settlement since they would be barred from also collecting a blood clot settlement, which is typically larger. Damages in blood clot cases can exceed $100,000, he said.
Women who do collect $3,000 for gallbladder removals may not be left with much after deducting lawyers’ fees, filing fees and the costs of obtaining medical records. Health insurance plans may also be able to claim any leftover amount to reimburse what they paid for medical expenses, Zoll said. Nevertheless, he strongly encouraged his clients with gallbladder injuries to accept the settlement.
While modest, the settlement was the best lawyers for the plaintiffs could achieve, Zoll said, given the lack of epidemiological studies showing that users of Yasmin and Yaz have a higher risk of gallbladder disease, compared to other oral contraceptives.

German drug maker Bayer has indicated to shareholders in its latest financial report that it will reserve an additional $262.5 million to settle Yaz and Yasmin lawsuits over blood clots, according to Dow Jones staff writer Friedrich Geiger on October 30, 2012 in an article for 4-traders.com.

The news follows a previous Bloomberg report on July 31st that Bayer would set aside $610 million to settle more Yaz cases at that time, for an average of nearly $212,000 per case. The report also stated Yaz settlements would be limited to cases involving blood clot injuries.

On October 25, 2011, the British Medical Journal published a study from the University of Copenhagen linking the hormone in Yaz to blood clots. On October 27, 2011, the FDA released its own study entitled "Combined Hormonal Contraceptives and the Risk of Cardiovascular Disease Endpoints" showing drugs like Yaz could increase the risk of blood clots, DVT and pulmonary embolism by as much as 74%.

The Yaz multidistrict litigation in Illinois has gained another lawsuit. The new lawsuit against Bayer, manufacturer of Yaz and Yasmin, was filed on May 15, 2012 in the U.S. District Court for the Southern District of Illinois (East St. Louis), by Massachusetts resident Janet Mahon, and was eligible to join the MDL because there is diversity of citizenship and the amount in controversy exceeds $75,000.
According to the lawsuit, Mahon began using the contraceptive Yaz in November 2006. She subsequently developed blood clots from Yaz which led to a pulmonary embolism on December 14, 2009.
Her lawsuit charges that Bayer knew, or should have known, about the contraceptives’ side effects, but did not warn Mahon, her doctors, the medical community, or the public. It goes on to say that if Mahon had known of the risk of these side effects, she would not have used this contraceptive. Because of Bayer’s failure to warn, the lawsuit accuses the the drug company of defective manufacturing, inadequate warning, design defect, negligence, strict product liability, breach of express and implied warranties, and fraud and deceit. She is seeking compensation for Yaz injuries, pain and suffering, medical and legal expenses, and economic damages.
Drospirenone in Yaz and Yasmin causes numerous deadly side effects
Yasmin, which was approved by the FDA in 2001, and Yaz, which was approved in 2006, both contain drospirenone, a synthetic progestin. Drospirenone has been linked to numerous life-threatening side effects, including hyperkalemia (elevated potassium levels), blood clots, pulmonary embolism, stroke, deep vein thrombosis, heart attack, gallbladder disease, kidney failure, pancreatitis, and in some cases, death. An FDA-commissioned study of 835,000 women found that women who use birth control containing drospirenone have twice the risk of blood clots as women who use other contraceptives.
More than 1,100 women have filed lawsuits against Bayer over side effects from Yaz. In a period of less than five years (from the first quarter of 2004 through the third quarter of 2008), the FDA received reports of 50 deaths of users of Yaz and Yasmin.

In an FDA advisory panel voted to keep Yaz and Yasmin on the market despite the known risk of blood clots. On March 9, 2012, four women’s groups sent a joint letter to FDA commissioner Margaret Hamburg protesting the decision and expressing concern that it will put women’s lives in jeopardy.

A study of 835,000 women commissioned by the FDA recently found that those who used birth control pills with drospirenone, such as Yaz and Yasmin, had twice the risk of developing blood clots as those who took non-drospirenone birth control pills. The popular oral contraceptives Yaz and Yasmin have been tainted recently by safety concerns raised by researchers, health advocates and lawyers for plaintiffs who have filed lawsuits against manufacturer Bayer Healthcare, the New York Times reports. These groups argue that the drugs put women at higher risk for strokes, blood clots and other health problems than some other oral contraceptives. Citing warning letters FDA sent to the company, plaintiffs' attorneys contend that Bayer was aware or should have been aware of the problems. These new concerns could "rattle consumer confidence" and harm the drugs' image as the "go-to brands for women under 35," according to some industry analysts, the Times reports. In 2001, FDA approved Yasmin, which contains drospirenone, a progestin that can increase the body's potassium levels. According to the drug's label, the potassium increase may put women with liver and kidney problems at higher risk for serious health problems. Yaz, which also contains drospirenone and a lower dose of estrogen, was approved in 2006 as both a contraceptive and a treatment for premenstrual dysphoric disorder and moderate acne. The drugs' popularity is due in part to multimillion-dollar advertising campaigns, and together Yasmin and Yaz brought in about $1.8 billion in worldwide sales in 2008 for Bayer.

FDA in October 2008 sent Bayer a warning letter for running two false and misleading TV ads about Yaz. FDA said the ads overstated Yaz's efficacy, promoted it for conditions — like premenstrual syndrome — for which it is not approved, and downplayed serious risks associated with the drug. Bayer agreed in February 2009 to spend $20 million on a corrective ad campaign to address the misimpressions from the original campaign.

FDA sent another warning letter to Bayer in August 2009, this time regarding deviations from quality control standards at a manufacturing plant in Germany that makes drospirenone and other hormone ingredients used in the pills sold in the U.S. The letter said methods used by the facility to calculate variability in ingredients did not meet U.S. standards.

According to Bayer, the company has been served with 74 lawsuits brought by women who say they developed health problems after taking Yasmin or Yaz. According to the Times, because the drugs' labels warn of the risk of blood clots and stroke, the plaintiffs could have difficulty winning on the argument that Bayer should have issued stronger warnings. The plaintiffs might be more likely to prevail if lawyers are permitted to use the FDA warning letters to argue that misleading advertisements enticed women to take the pills, exposing them to health risks that they might not have otherwise encountered.

An FDA spokesperson said the agency is reviewing the safety of oral contraceptives through a study designed to identify the incidence of blood clots, stroke and death among users of Yasmin and other oral contraceptives. Meanwhile, officials with Bayer said the company plans to vigorously defend itself against the lawsuits. Bayer also is conducting a postmarket study comparing Yaz's safety with that of other oral contraceptives (Singer, New York Times, 9/26).

Yasmin, which is made by Bayer Inc., is one of  united State's top-selling birth control pills. It is a so-called "fourth generation" hormonal contraceptive and is considered "low dose."

Blood clots can cause a blockage of arteries that carry oxygen-rich blood from the heart to other tissues resulting in:
