Bayer agrees to settle Yasmin, Yaz Gallbladder lawsuits

Bayer’s latest annual financial report shows the company has spent nearly $1 billion to settle around 4,800 claims alleging Yaz blood clots, and will continue to evaluate new claims for settlement on a case-by-case basis.
(Reuters) – Bayer AG has entered into an agreement to settle lawsuits filed by plaintiffs who claim to have suffered gallbladder injuries from the company’s Yasmin and Yaz oral contraceptives, according to court documents.
In a deal reached on Friday, Bayer agreed to pay up to $24 million to settle gallbladder injury claims consolidated in the U.S. District Court for the Southern District of Illinois, as well as in state courts in California, New Jersey and Pennsylvania.
Under the agreement, Bayer will pay $2,000 to plaintiffs who suffered gallbladder injuries and $3,000 to individuals who had their gallbladders removed, according to the agreement. The gallbladder mainly aids in fat digestion, but it is a non-essential organ people can generally live without, according to the National Digestive Diseases Information Clearinghouse.
The payments may be reduced, depending on the number of women who file claims, as the settlement is capped at $24 million. Bayer reserved the right to walk away from the settlement if fewer than 90 percent of the individuals who are eligible for payment choose to participate in the settlement.
Bayer said in a statement that it did not believe that the Yaz and Yasmin birth control pills increase the risk of gallbladder disease, compared to other oral contraceptives.
“Nevertheless the company has agreed to this settlement, without admission of liability, in order to avoid protracted and expensive litigation and to resolve the vast majority of pending gallbladder claims,” a Bayer spokeswoman said in an emailed statement. She said the $24 million settlement was likely less than the legal costs of defending against the suits.
Since 2009, Bayer, Germany’s largest drugmaker, has been hit by a wave of lawsuits claiming that the company knew or should have known of the health risks allegedly posed by the Yasmin and Yaz contraceptives and failed to warn users. The company is facing around 10,000 lawsuits in the United States over the drugs, Bayer said in its annual report filed in February.
The report said Bayer had reached agreements to pay $1 billion to settle claims by 4,800 women or their representatives in the United States who say the pill caused blood clots that resulted in heart attacks, strokes or other injuries. After reviewing safety data, the Food and Drug Administration in April 2012 ordered revised labels on birth control pills, including Yasmin and sister drug Yaz, to strengthen blood clot warnings.
There are around 8,000 filed lawsuits that allege gallbladder injuries, said David Zoll, an Ohio lawyer representing 500 women who say they suffered a range of injuries from Yasmin and Yaz. The latest settlement is open to plaintiffs who alleged a gallbladder injury, either alone or in combination with some other claim.
Zoll said it would be “foolish” for women with both gallbladder and blood clot injuries to opt for the gallbladder settlement since they would be barred from also collecting a blood clot settlement, which is typically larger. Damages in blood clot cases can exceed $100,000, he said.
Women who do collect $3,000 for gallbladder removals may not be left with much after deducting lawyers’ fees, filing fees and the costs of obtaining medical records. Health insurance plans may also be able to claim any leftover amount to reimburse what they paid for medical expenses, Zoll said. Nevertheless, he strongly encouraged his clients with gallbladder injuries to accept the settlement.
While modest, the settlement was the best lawyers for the plaintiffs could achieve, Zoll said, given the lack of epidemiological studies showing that users of Yasmin and Yaz have a higher risk of gallbladder disease, compared to other oral contraceptives.

New England Journal of Medicine June 2012 Study

The New England Journal of Medicine published a study on June 14, which suggests that these forms of birth control that contain a combination of estrogen and progestin can double a woman’s risk of having a heart attack or stroke.

The Danish study, analyzed more than 1.6 million women aged 15 to 49. These women were taking low-dose estrogen birth control pills combined with progestins. They suffered heart attacks and strokes between 1.5 and 2 times more often than women not using hormonal contraception. The risks were as much 2.5 to 3 times higher among users of combined hormonal device, including vaginal rings, compared to non-users. The highest risks were seen in women over 45, or those who had high blood pressure.

In 2008 the FDA sent Bayer an eight page WARNING LETTER (bolded and all caps to emphasize the seriousness of the matter) telling the company that changes needed to be made to their commercials for Yaz and Yasmin.  The problems the FDA cited in regards to the commercials were the representation of the medications’ effects on PMS, acne, and the minimization of risks.

In response to the WARNING LETTER, Bayer changed their commercials and clarified the points the FDA had requested.  The commercials emphasized that Yaz only helps with PMDD and not PMS.  The edited version explained that Yaz and Yasmin don’t completely get rid of acne but can help decrease pimples. Scientists in the U.S have reported safety concerns over the popular  birth control pill Yaz which they believe can increase the risk of dangerous blood clots more than older medications.

A new study released by the Food and Drug Administration reviewed the medical history of more than 800,000 U.S. women taking different forms of birth control between 2001 and 2007.

Under scrutiny: Scientists have raised concerns over the likelihood over woman developing blood clots if they take Yaz as a form of birth control

On average, woman taking Yaz had a 75 percent greater chance of experiencing a blood clot than women taking older birth control drugs.

Yaz contains estrogen along with a next-generation synthetic hormone called drospirenone, which is known to increase potassium levels in the blood. The means that Yaz can cause heart attacks.

Yaz, Yasmin and related drospirenone-containing pills were Bayer's second-best-selling franchise last year at $1.6 billion in global sales.

In 2009, the FDA took the unusual step of ordering Bayer to run corrective TV advertisements for Yaz on the ground that the drugmaker's marketing campaign overstated the drugs' ability to prevent acne and premenstrual syndrome.

Carissa Ubersox (left), a paediatric nurse from Madison, Wisconsin, went into a coma and was blinded after taking Yaz.

Ubersox, 24, started using the birth control pill in the run up to her wedding but three months later she ended up in hospital after her heart stopped.

She is now suing the company after blood clots in her legs had moved to her lungs, causing a double pulmonary embolism.

One the way to hospital her heart stopped. She was revived but went into a coma for almost two weeks.

What is yaz ?

Recent studies have reached differing conclusions on the risks of newer birth control pills.

A study published this week involving more than 1 million Danish women found that women taking Yaz and other newer medications had twice the risk of blood clots as women taking the older hormone levonorgestrel.

The findings appeared Tuesday in the British Medical Journal.

However, two studies published in 2007, conducted as part of the post-marketing requirements of the FDA or European regulators, did not find any difference in blood clotting between the two comparable groups.

Birth-control pills that contain drospirenone include Bayer's Yaz, Yasmin, Beyaz, Safyral; Sandoz's Syeda and Loryna; as well as Barr Laboratories' Ocella, Watson Pharmaceuticals' Zarah and Teva Pharmaceuticals' Loryna.

Texas cannot exclude Planned Parenthood from health program-judge

AUSTIN, Texas (Reuters) – A federal judge on Monday temporarily blocked a new Texas rule that would have excluded Planned Parenthood clinics from offering women's health services for the poor in the state because the organization provides abortions.

The ruling by U.S. District Judge Lee Yeakel in favor of Planned Parenthood means thousands of women enrolled in the Texas Women's Health Program who go to its clinics will not be required to find new healthcare providers, at least for now.

"The court is particularly influenced by the potential for immediate loss of access to necessary medical services by several thousand Texas women," Yeakel said in a 24-page ruling.

The preliminary injunction is a big win for Planned Parenthood, which has been under siege in several states by abortion opponents. In the past year alone, states including Wisconsin, North Carolina, Tennessee and Indiana, in addition to Texas, have all moved to block Planned Parenthood from receiving taxpayer money.

"For many women, we are the only doctor's visit they will have this year," Cecile Richards, president of Planned Parenthood Federation of America, said in a statement. "This ruling affirms what women have known all along: politics simply doesn't have a place in women's health."

The state Health and Human Services Commission will comply with the order and will work with the state attorney general to determine its next steps, spokeswoman Stephanie Goodman said.

"We remain confident that federal law gives states the right to establish criteria for Medicaid providers," Goodman said.

Texas Governor Rick Perry and some Republican lawmakers have said they would rather eliminate the women's healthcare program entirely than direct money to Planned Parenthood clinics.

The Texas program, which is part of the federal-state Medicaid program, provides cancer screenings, birth control and other health services to more than 100,000 low-income women.

The program does not pay for abortions or allow abortion providers to participate in the program. The new Texas state rule would ban program money from going to affiliates of abortion providers.


State law has included that ban on affiliates since the program began in 2007, but the state did not enforce it. Texas notified the federal government last year that it intended to begin enforcing the ban, effectively excluding Planned Parenthood from the program.

According to Planned Parenthood, about 49% of the women who received services through the program in 2010 obtained some services through a Planned Parenthood provider. Planned Parenthood said it would lose about $13.5 million of annual funding for preventive care and family planning if the rule is applied, forcing it to close clinics and lay off staff.

Texas has already made deep cuts in other family-planning programs. As a result, state subsidies that once provided low-cost birth control to 220,000 women a year now cover fewer than 60,000 women a year.

The federal government pays for 90% of the cost of the Texas Women's Health Program, which serves low-income women of reproductive age who do not qualify for regular Medicaid coverage. Texas puts up just $4 million a year.

Critics object to Planned Parenthood receiving taxpayer money, which cannot be used to provide abortions, arguing that a steady stream of government grants provide an indirect subsidy by helping pay utility bills and keep doctors on staff.

Planned Parenthood is the nation's largest abortion provider, terminating about 330,000 pregnancies a year.

It gets about a third of its revenue – $360 million in 2009 – from government grants to provide birth control, gynecological exams and care for sexually transmitted diseases to low-income women.

           Yaz Causes Blood Clots, Pulmonary embolism, deep vein thrombosis, stokes and heart attacks. Yaz has destroyed the future of many young women and some have died. Fosamax was tauted as the cure all to poor bone density and osteoporosis. Doctors. lured by pharmaceutical company representatives. Imagine a drug for Osteoporosis causing femur fractures. It is almost an oxymorone. As we move along we have Yaz and Yasmine birth control pills. These were taken by young women to offer more freedom. Bayer had special parties where young wome were convinced the these drugs would help their social life. Many social service organizations were offering these to prevent unwanted pregnancy and college campuses were offering a new found sexual freedom. In the age of liberation this was the wonder drug until the complications set in and college girls  were ending up in emergency rooms. Mothers were losing daughters and young women were having their lives dramatically altered by pre-mature strokes and heart attacks. it appeared the chemical base of Yaz and Yasmin increased the potassium in the blood. Postassium effects the rhythm of the heart and heart attacks were occuring. Yaz and Yasmin also caused blood clots, deep vein thrombosis and pulmnary embolisms in young women. Many just girls barely starting a college life


       History moves along and even the DePuy Hip Replacement, a metal on metal hip replacement recalled for its's vast need for revision surgery effects women more then men. Apparently ithe smaller frame of a women makes the device more prone to problems in the female statute.

      And here come the biggest disaster for women, the various vaginal mesh devices for urinary incontinence and uterine, bladder and bowel prolapse. This mesh device is made of a Prolene plastic synthetic fiber and apparently is not holding up. Wome across the country are screaming the horrors of the vaginal mesh. They are in severe pain. Some describe it as razor blades. The mesh is eroding thru the vaginal wall and at times itnot the bladder and bowel. having it removed appears to have its issues as well. Women can no longer have sexual intercourse and marriages are breaking up. Women cannot work and are losing their jobs and health insurance.  Even if there was a Doctor to help they have not money to pay for it. Last but not least we have the Mirena IUD. Apparently the Mirena Slicone IUD. Sound familiar?

The Mirena silicone IUD is showing side effects very reminiscent of the old Dow Silicone breast implants. We also have women prone to breast cancer who should not be implanted with it and the estrogen component is showing evidence of Breast cancer in some women. And last but not least it is gravitating out of position and effecting other near by organs by cutting or severing .

All in all we have many medical devices and drugs effecting women. When a women trusts a doctor it is devastating to find out they were harmed. Women are becoming depressed with sever emotional ramifications from devastating illness and complications. Many feel their loves have been ruined. Chat room are full of "MY experience " with—-. These stories are not pretty and many are stories of loss and a life ruined.

And one must continue to watch in awe as our T.V screens are filled with lawyers seeking to vindicate these women. Many are quite sensitive to the issues. We see one after the other. So many of these are the drugs and devices that harm women. can a dollar settlement help a ruined life?
